Has State Representative Tracey Bernett violated Colorado law?
Is she lying to her voters by pretending to live in a different town?
Bernett is facing allegations that she “illegally voted in the 2022 June Primary,” and that she may not qualify “as a legal resident in House District 12 for the purpose of running as a candidate…”
Bernett, a little over a year ago (just before the deadline for this year’s election) changed her voter registration to a Louisville apartment.
However, there seems to be substantial evidence that Bernett’s Longmont address is still her “primary residence.”
If true, this means that renting an apartment was only a scheme for her to be able to again run for her current seat.
The Complaint
On September 19th, 2022, Theresa Watson, the Chairman of the Boulder Republican Party, issued a complaint to Michael Dougherty, the 20th Judicial District Attorney.
Watson’s 14-page complaint contains a lot of information alleging that Bernett’s residence is actually in Longmont, not Louisville.
Bernett’s Longmont address was valid for House District 12, which she currently represents.
However, after redistricting (due to the 2020 census), Bernett’s Longmont address is now in House District 19.
If her Longmont address has been her primary residence since 1996, it may seem unlikely that she moved into a Superior apartment.
Watson’s complaint presents the argument, and provides plenty of information for the DA to consider:

The Longmont Times-Call reported on this complaint back in September, but Bernett “could not be reached for comment.”
The Gazette reported that Bernett living outside her district could be considered an “open secret.”
After considering her evidence, Watson’s concerns seem valid.
Are voters supposed to believe that last year, Bernett moved out of her 4,100 square foot, $1.5 million house to live in a small apartment in Louisville?
How does Bernett charge her electric vehicle every night if there is not a charging station at her apartment?
Does Bernett think she is above the law?
Does Bernett think she shouldn’t have to abide by the redistricting decisions of our State Government?
Will the District Attorney’s office continue their investigation?
Are the voters in her district aware of the possibility that Bernett does not live in their district?

Who is Tracey Bernett?
I also think it’s important to document that Bernett is no friend of Freedom.
Let’s take a quick look at her record.
Tracey Bernett is one of Colorado’s most authoritarian politicians.
She wants to ban firearms.
She wants to eliminate natural gas use in new homes.
She also supports a variety of legislation that would increase the State’s control over our lives.
The Liberty Scorecard gives Bernett a lifetime score of 9 (out of 100).
The Colorado Union of Taxpayers gave Bernett a score of 6% (again, out of 100) during the 2021 Legislature.
Clearly, Bernett does not vote with the intention of supporting property rights, economic liberty, or freedom of the individual.
