Larimer County Officials have overstepped their authority.
Not only have they instituted a Mask Mandate, attempted a Vaccine Passport System, but they have also conspired to target the free speech of dissenting citizens!
The Background
On October 20th, the Larimer County Department of Health and Environment (LCDHE) issued a mask mandate for the county.
This order has led to massive non-compliance, calls to boycott the county, and outrage among the citizenry.
Additionally, the LCDHE attempted to institute a “Vaccine Verified Facility & Event Program.”
This program would have authorized a Vaccine Passport system across the county.
The order would have allowed businesses to become “Verified” if nearly all their employees were vaccinated, and all visitors to the facility had their vaccine status verified as they entered.

Thankfully, due to massive outrage from the community during the October 21st Board of Health Meeting, the County paused the Vaccine Verification Program.
Over 100 people signed up to speak at the meeting, and hundreds were watching on Zoom.
This victory is a measure of how the community is mobilizing against Larimer County’s Authoritarian Mandates.
One group that is helping to lead the pushback against the county’s mandates is Take Back Colorado.
Their petition and mass mobilization of the community helped to inform citizens about the Board of Health Meeting.
Even though the Vaccine Verification Program has been stalled, the mask mandate continues.
And just yesterday, County Politicians engaged in a conspiracy to target an individual critical of their agenda.
Tom Gonzales’s Attack on Free Speech in Larimer County
On October 26th, 2021, Larimer County Public Health Director and Board of Health Secretary Tom Gonzales sent an email asking for help:

Dear Larimer County leaders,
For over 52 years the Larimer County Department of Health and Environment has worked tirelessly to provide everyone in Larimer County the opportunity for a healthy life. A local public agency that has responded to the needs of the community during and after catastrophic floods and fire, West Nile Virus outbreaks, meningococcal outbreak, TB, waterborne outbreaks, polio, salmonella and many other public health emergencies.
But now there is a group of people (small, yet vocal) intimidating our caring public health staff for our difficult work with suppressing COVID-19. This trailer and the horrible message is sitting next to your public health department in Fort Collins.
I am asking for your help to get this removed and out of our compassionate County. All we are trying to do is reduce COVID-19 hospitalizations on our all-ready overwhelmed hospitals. Thus, freeing up beds for all urgent medical emergencies.

Further, while I understand that Tom and his staff may be offended by the message, as someone versed in Constitutional law, I believe that speech falls under the protection of the 1st Amendment. If Tom Gonzales had a problem with the statement displayed on a private citizen’s trailer, why did he feel it necessary OR appropriate to email his complaint to 23 individuals??? WOW! Isn’t trying to enlist 23 community leaders to harass and silence a private citizen who is exercising their 1st Amendment rights, a bit excessive? If the trailer is illegal, it should be removed. Nothing to do with the message. If it is parked legally, leave the trailer be and it’s message, no matter how distasteful it may be.
Based on these emails the land owner has a right to file a title 42 USC 1983 civil rights violation.
They are indeed conspiring to use the color of local law to deprive a person of their constitutional rights.
Because there is more than one party and threats of multiple actions in Colorado you only need two predatory acts for charges of racketeering against these individuals.
They have violated their oath of office and betrayed the public trust.
This kind of us vs them thinking is dangerous and the antithesis of the foundation of our country and ity ideals, and these officials should be removed from public office immediately, imprisoned and fined to send a clear message and example to public officials who think this kind of action is appropriate.

Fortunately because of the supreme Court case knick vs township of Scott. The Williamson case was overturned. This means for constitutional rights violations you can go directly to district court and bypass the lower State and local courts.

We loved to see the sign on the trailer!! I have a bumper sticker similar to it on my truck in addition to a bumper sticker that reads “DON’T BE A MASK SLAVE”. I have had lots of favorable comments on these from a wide spectrum of Larimer County citizens. It is beyond belief that 3 County Commissioners and a handful of “health” judges could ever get a large portion of the people of Larimer County to voluntarily submit to such tyranny! I fought for this country and for our freedoms and I will not submit. If you have no control over your own body you are by definition a SLAVE. I am very thankful that our elected Larimer County Sheriff stands on the side of FREEDOM. Has is been so long, America, that you think FREEDOM comes from the rulers and not from the PEOPLE?!

MEDIA STATEMENT REGARDING LARIMER COUNTY OPTIONAL VACCINE VERIFIED FACILITY AND EVENT PROGRAM
We realize that we failed to clearly communicate information about the optional Vaccine Verified Facility and Event Program to our businesses and the community. We hope to clarify any ongoing confusion, and we are dedicated to improving communication about the program with our business partners moving forward.
Due to area hospitals being overburdened with COVID-19 patients, most of whom are unvaccinated, on October 20, 2021, the Larimer County Department of Health and Environment (LCDHE) issued the Ninth Public Health Order of the pandemic. The order requires mask wearing in all public indoor spaces by everyone ages three years and older.
Also, part of the order was an optional opportunity for businesses to become a Vaccine Verified Facility and be excepted from requiring masks in their facility if 95% of their staff, customers, and clients provided proof of being vaccinated against COVID-19. However, after realizing that the program details had not been communicated clearly, the program was paused for the department to take a step back and evaluate the details in conjunction with community businesses.
Thirty-three facilities or events were initially approved for the Vaccine Verified Facility and Event Program. These businesses already had policies requiring staff and customers to be vaccinated ahead of the public health order being issued. However, with the program on pause, these businesses must enforce mask wearing in their facilities. We know this transition has been confusing and understandably frustrating to many in our community.
Currently, we are listening to constructive feedback from Larimer County businesses, the local Chambers of Commerce and the Economic and Workforce Development Department about the program. Feedback for the Vaccine Verified Facility and Event Program can be submitted to LCDHE online at https://bit.ly/larimerfeedback.
We will share additional information with the community based on that feedback in the coming weeks. We encourage our residents to visit http://www.larimer.org/covid19 for the most accurate and up-to-date information about COVID-19 in Larimer County.

I just wanted to be sure you were aware of this demonstration planned for tomorrow morning.
I am totally DISGUSTED by this email I rec’d today (can’t imagine how I got on this list). Except that I’m currently under the weather, I would be at the LCDHE tomorrow at 10 to support our hard working public health staff. This is so WRONG! I’m hoping there will be a counter-demonstration that is 10X theirs.

We have all heard that the Larimer County Department of Health and Environment has issued a sweeping mask mandate based on arbitrary criteria. But did you know that they simultaneously revealed a taxpayer-funded vaccine passport system? LCDHE will exempt companies and organizations from the unnecessary mask mandate if the organizations commit to excluding unvaccinated employees and patrons from their premises– despite the fact the CDC warns that COVID vaccines do not stop transmission.
To make matters worse, LCDHE plans to provide taxpayer dollars to organizations willing to enforce vaccine passports on patrons– using our own money to segregate our county, not only by medical choice, but by race. As of October 4, at least 42% of African American Coloradans and 64% of Hispanic Coloradans would be excluded from businesses enforcing vaccine passports.
The vaccine passport system, which LCDHE has entitled the “Vaccine Verified Facility” program, detailed on their website, will be launched on Monday, November 1, 2021. Del Bigtree and Michelle Malkin will be at the Fort Collins location of Larimer County Health from 10AM to noon, November 1, to protest the vaccine passport program and its funding with hard-earned Coloradan tax dollars. Just got your note, Sue, as I was in the middle of typing this. Hope this helps you understand. And understand that I keep this private because I do not want to embarrass anyone or create more of the situation than has already hit the streets.
The simple answer to yours is yes, Sue. None of us has the right to silence any other. You are free to disagree with someone, free to put up a contrary sign on your own property; but certainly no one is free to use an elected position to try to silence a person, nor to use an association to do so.
Beyond that principal and addressing this specific situation — and this is very important – Charlie no more aimed his missive at rank and file health care workers than you or I would. In the interest of fairness, here I insert that one of those “in the know” on the whole thing disagrees with me, showing me that Charlie is after unelected bureaucrats. It’s the bosses he’s after. He is aiming it at government overreach and those in Big Business, Big Education, Big Medical, Big whatever, who follow along. It is an unfortunate but common practice when people “discuss” issues to resort to ad hominem attacks rather than stick to the point. In this case that ad hominem attack includes trying to marginalize a fed up guy by (falsely) claiming that his attack is on the rank and file worker. It serves the double purpose of getting us off of the Real Issue.
Might there be upset health care workers? Sure. Might there also be health care workers who are happy he’s saying it. You bet. To buttress my case on that, here is a headline that was accompanied by pictures of crowds of workers demanding that government back off the mandates (I could not get the pictures to copy) — Videos of California Health Care Worker Demonstrations
I note, by the way, that someone called unvaccinated people “selfish” yesterday in a public email. That is harsh. I tried to make the point that it isn’t true, that there are valid, serious reasons for not being vaccinated. In the various backs and forth on the matter, I have not seen ANYONE ask whoever said that to apologize or withdraw the harsh accusation.
One final question for you, Sue. And I am genuinely interested to know. It is not a trap question. Has anyone in NFCBA ever tried to publicly silence you, using the NFCBA as the weapon of choice? It certainly never happened when I was on the BOD. And you certainly are not quiet about your opinions and requests.

I added Charlie, Greg and Dean because I do believe this is about NFCBA. Charlie would say that we are friends and we have had many open discussion which I believe are healthy for both of us. Charlie is actually the reason I’m on the NFCBA board.
Sorry I wasn’t able to respond earlier. Its my birthday week and I have been tied up.
I am not trying to silence Charlie. I was asking how this reflects on us as a community and how it hurt the public servants that serve us. It hurts me to my soul. Our public health system is in a crisis and we want to pour salt in the wound. I don’t get it. A mask seems like a simple act of compassion. It is also your right to get a vaccine or not. I personally, don’t want to be around unvaccinated people because I don’t want to carry a viral load to my family members. My right also. The vaccine has allowed me to travel around Europe for 7 weeks and to many national parks this summer without any health problems. I am totally grateful for science.
I agree that Charlie has the constitutional right to say what every he wants against public servants. Our fragile democracy insures that. But I do believe we have a moral obligation to do what is right rather that what we have the right to do.
I hope you will read David Brooks’, Republican NY Times writer, book entitled the Second Mountain: The Quest for a moral life. I’m happy to give you a copy. As leaders in our community, you will leave a legacy and get to decide how you live your “second mountain”. Do you weave a stronger community for future generations or do you focus strictly on inward? Do we burn down the trust and democracy that generations have worked so hard to build?
I really want the Walter Cronkite days back. The extremes are tearing us apart. What caused all the lack of faith in our government and basic civility and respect? Why did I have to leave my home for my safety to be an ceremonial Elector? I think we have reached a tipping point and really consider where we get our information from and how we weave community, not distrust. I think Charlie and I model that when we talk.
I don’t know the answer. Please know that this fear is unfounded and the community elected and appointed care about you and the overflowing hospitals and the public servants. There is no conspiracy behind this. There is always another election in a couple years that you can change the elected.

Either these people are lying or they’re just clueless about the extent of the COVID hospitalizations in Larimer County. I suppose it’s a little of both…..or a lot of both. They’re using the excuse of overflowing hospitals due to COVID to push these draconian mask and vaccination mandates down our throats. Unless I’m misunderstanding the data as of October 15, there are 716 beds in 6 Hospitals in Larimer County with a 7-day average of 100 COVID patients, or only `14% of the beds. I’m sure many of these hospitalizations are for elective surgeries that could easily be delayed. Stop this absurd nonsense!

Larimer County Commissioners:
By now, you’ve certainly seen the email from Tom Gonzales, the County’s Public Health Director. And I trust you’ve seen the legitimate debate that has ensued.
It is clear that Mr. Gonzales attempted to use his government connections to quash the free speech rights of a local citizen. He clearly doesn’t understand the Constitutional limits that are placed on the government in order to protect the Natural Rights of the Citizens.
It is clear that Mr. Gonzales asked you to compromise your oath of office in order to bend the rules to remove the message on the trailer.
It is clear that Mr. Gonzales is unsuited for this office if he is so intimidated by the peaceful free speech of a private citizen.
The undersigned members of the Colorado General Assembly urge the County Commissioners to direct the Board of Health to immediately terminate Tom Gonzales as the Public Health Director. Larimer County deserves a thoughtful Director of Public Health that understands that the Rights of the Citizens do not end when his feelings are offended.
