Last week, Larimer County Public Health Director Tom Gonzales used his position to attempt the silencing of County Critics!

This morning, State Senators Rob Woodward, Barb Kirkmeyer, and State Representatives Hugh McKean and Mike Lynch sent the following email to the Larimer County Commissioners and Board of Health:

Larimer County Commissioners:

By now, you’ve certainly seen the email from Tom Gonzales, the County’s Public Health Director. And I trust you’ve seen the legitimate debate that has ensued.

It is clear that Mr. Gonzales attempted to use his government connections to quash the free speech rights of a local citizen. He clearly doesn’t understand the Constitutional limits that are placed on the government in order to protect the Natural Rights of the Citizens.

It is clear that Mr. Gonzales asked you to compromise your oath of office in order to bend the rules to remove the message on the trailer.

It is clear that Mr. Gonzales is unsuited for this office if he is so intimidated by the peaceful free speech of a private citizen.

The undersigned members of the Colorado General Assembly urge the County Commissioners to direct the Board of Health to immediately terminate Tom Gonzales as the Public Health Director. Larimer County deserves a thoughtful Director of Public Health that understands that the Rights of the Citizens do not end when his feelings are offended.

On November 3rd, Larimer County Democratic State Legislators: State Senator Joann Ginal, and State Representatives Cathy Kipp, and Andrew Boesenecke sent the following email to the County Commissioners:

Dear Larimer County Commissioners,

As your elected colleagues, we want you to know we are incredibly grateful for the leadership of Larimer County Health Director Tom Gonzales, his team at the Larimer County Department of Public Health and Environment, and the Larimer County Health Board. They have done so much to keep us all safe and healthy – especially during the last 20 months of the COVID-19 pandemic. This global pandemic has been challenging for everyone, but even more so for our Larimer County Health team who have been on the front lines of managing and mitigating this ongoing crisis. The science is clear – not only is the COVID-19 vaccine the most safe and effective tool we have in order to fight this deadly virus, but masking is also necessary when infection rates continue to climb and our hospital systems continue to be strained. These are simple measures that we can all take in order to keep our community safe.  

We understand that some of our colleagues in the state legislature have called upon you to retaliate against our Larimer County Health Director for following the science and for taking the necessary and prudent steps needed to keep the residents of Larimer County safe. We believe you should instead applaud the efforts of Tom Gonzales and our Larimer County Health team for doing this hard work to protect the health of our community.

It is unfortunate that an extremely vocal minority of people have made public health so divisive. But they are just that –  a small number of people, many of whom are not residents of our county, who either don’t believe in science or refuse to trust peer-reviewed credible information.

The majority of us support our Larimer County Health team and the work they have done and continue to do to keep us all safe. The majority of our community, including our constituents, have been asking for a mask order to relieve the burden on our hospital systems and healthcare workers. Public health professionals should be lauded more often for the great work they do. They generally do it so well that people continue to go about their business without ever knowing they are there, working behind the scenes, protecting and improving our health and that of our entire community. Public health should not be a partisan issue. 

We want to take this opportunity to publicly thank Director Tom Gonzales and our Larimer County Health team for their continued work to keep us all safe and healthy despite the attacks and misinformation they continue to face. Please know that there are many of us who appreciate and value the work they do, and who firmly believe that the latest public health order will indeed save lives. We hope you, our Larimer County Commissioners, will take this opportunity to express your support of our excellent Larimer County Health team as well.

That’s right, these State Legislators publicly asked the Larimer County Commissioners to “applaud the efforts of Tom Gonzales and our Larimer County Health team…”

They are completely out-of-touch with their constituents!

Of course, it’s not surprising that supporters of Governor Jared Polis support medical tyranny.

And what’s their excuse for IGNORING the voices of their constituents?

They say that only “an extremely vocal minority of people have made public health so divisive.”

In their eyes, if this “minority” of individuals would only accept restrictions on their rights and shut up, there wouldn’t be a problem.

Instead of defending the rights of the “minorities” in their community, these so-called officials defend the calls for silencing citizens of Larimer County.

They seem to think only a minority of the population is willing to defend our Natural Rights.

They need to hear from their voters!

    Thank you for this email and sharing your experiences and your opinion. I attended the rally yesterday and also found it very peaceful and respectful of everyone’s right to free speech. I also got to say hello to many of my friends and colleagues who were speaking.

    Fort Collins will follow the advice from our Director of Public Health and his elected Board of Health.

    We are in receipt of your letter dated November 1, 2021 urging us to direct the Board of Health to
    immediately terminate the Larimer County Public Health Director. We wish to clarify three points raised by
    the correspondence.
    The Board of Health is an independent body established under the parameters set forth in Colorado State
    Statute. By design, the Board of Health has autonomy from political bodies such as the County
    Commissioners and state elected officials. The wisdom of that statute is that public health is a matter of
    science and medical options and should not be subject to political influence. We do not have the authority
    to direct the established Board of Health.
    We’d like to clarify the facts behind the October 26, 2021 email string originating from the Public Health
    Director about the trailer parked on private property near the Larimer County Public Health Department
    office. The trailer was in essence a sign, not a transportation vehicle. We regret responding to the email
    string because of the perception it has created that we were attempting to suppress free speech. We
    value free speech as is evidenced by the multiple lines of communication we nurture with our community.
    Our replies centered around the potential sign code or land use code violations the trailer might
    represent. In hindsight, we should have left those questions to the City of Fort Collins that has jurisdiction
    over sign codes and land use codes in their municipality.
    When we step back and look at the enormous impact COVID-19 is having on our county, the state and
    the nation, we see not only health impacts, but also the impacts of disharmony and division in our
    community. Those forces threaten us all even after science eventually triumphs over the virus. We ask
    that you use your power and influence to help bring people together. Calm and patient leadership should
    be practiced by elected officials like the four of you and the three of us in this trying time. We are
    committed to sincerely hearing the voices of all, supporting our public health officials, and fostering
    compassionate unity of all community members. We welcome your ideas for achieving these goals.
    Together, we’ll get through this crisis.

    Words are inadequate to describe my profound disappointment in your recent letter to the Larimer County Commissioners expressing your support for the unconscionable actions of Tom Gonzales.

    In that letter, you write:

    “As your elected colleagues, we want you to know we are incredibly grateful for the leadership of Larimer County Health Director Tom Gonzales, his team at the Larimer County Department of Public Health and Environment, and the Larimer County Health Board.”

    Your letter is supporting a man who attempted to use the power of government to silence the free speech of a citizen who disagrees with Mr. Gonzales. While an open debate can be had on what is polite discourse and what is insulting and impolite, certainly nobody can argue that “resist fascists” is protected free speech under the First Amendment of the Constitution of the United States. That you would support his attempts to silence that speech is deeply disturbing.

    “We understand that some of our colleagues in the state legislature have called upon you to retaliate against our Larimer County Health Director for following the science and for taking the necessary and prudent steps needed to keep the residents of Larimer County safe.”

    This is an amazingly tone deaf statement, considering that the protests of Mr Gonzales are not for “following the science” but for attempting to suppress free speech and expression. That would be clear if you bothered to LISTEN to the critics. But since you went there, let’s discuss that. You stated that it is “an extremely vocal minority of people have made public health so divisive.” This matters not. That “minority” are still free citizens, and the implication is that everything would be better if that “minority” would simply shut up, accept restrictions placed upon them by an unelected, unaccountable bureaucrat with no experience in healthcare, and do as they are told. Do you not support minorities, Senator and Representatives?

    You state that they “either don’t believe in science or refuse to trust peer-reviewed credible information.” Do you know the educational background of all of these people? Are you saying that all of the critics of Mr. Gonzales are stupid and uneducated? That they are incapable of reading and forming their own conclusions?

    This is how you view citizens of Larimer County?

    Is it so unreasonable to question the decisions made by the Larimer Board of Health, given how much credibility public health officials and legislators have thrown away over the past 20 months? “It’s just 2 weeks to flatten the curve…” turned into “One month to slow the spread” which turned into “… Just until there is a vaccine” which morphed into “70% vaccinated rate” which became “a booster shot”… There has been talk of implementing a vaccine “passport” system (thankfully put on hold – for now). “Two weeks to flatten the curve” turned into “Show your papers to enter” in a big damn hurry, yet we citizens should not be allowed to question this?

    Here is a reminder: If it cannot be questioned, it is not science.

    I could go on, but I believe my point is clear. You, in your letter, show support for a man who attempted to use government power to silence his critics, indicate that people who don’t agree with the actions of a bureaucrat are uneducated and don’t believe in science, and that things would be better if minorities would simply shut up and do as they are told.

    And you wonder why trust in government is at an all time low.

    I’m disgusted with your actions. You should all be ashamed.

    Thank you for your advocacy and concern. The incident in question concerns the parking of a semi trailer (with the message “Resist the Fascists” painted on the side) inside of Fort Collins city limits. This trailer was, to the best of my understanding, previously parked outside of city limits. Signage like this is not in compliance with city ordinance.     (G)Prohibited signs and sign elements.

    (d)Semi-trailers, shipping containers, or portable storage units, unless:1.The trailers, containers, or portable storage units are: a.Structurally sound and capable of being transported; b.Used for their primary purpose (e.g., storage, pick-up, or delivery); and c. If subject to registration, have current registration and tags; and 2.The display of signage is incidental to the primary purpose; and 3.The semi-trailer, shipping container, or portable storage unit is parked or placed in a designated loading area or on a construction site in an area that is designated on an approved construction staging plan.

    I have seen a few emails that are similar to the concerns you raise, stating that Director Gonzales was attempting to rob individuals of their constitutionally protected rights and/or that the data around the pandemic is misleading or false. I do not believe this to be an accurate representation of the situation and/or Director Gonzales’ intent. Additionally, the Larimer County COVID-19 dashboard provides a clear and transparent snapshot into the trends impacting our community. As of this email, our ICU utilization is well above capacity at 118%. The vast majority of COVID-19 hospitalizations are among individuals who are unvaccinated.

    Public health is not a partisan issue. The vaccine is proven to be the safest, most effective tool we have to combat COVID-19. Masking is necessary when transmission rates spike and our hospital systems continue to operate above capacity. As such, and in the midst of a sustained uptick in infections and hospitalizations in our community, the Larimer County Department of Health and Environment issued a new public health order. Rightfully so, masks are now required in Larimer County for all indoor public spaces. This is a simple and prudent measure we can all take in order to get through the pandemic together. The health department also continues to receive feedback from community members and businesses, adapting and clarifying their guidance in response. I continue to stand in support of Director Gonzales and his team. Thank you again for reaching out and for your concern.

  7. Dear Christi,

    Thanks for reaching out.

    Yes, l am aware Tom Gonzales asked to have an illegal sign removed from private property. The sign is in the city of Fort Collins and violates the city sign code. I don’t think this qualifies as shutting down people’s right to free speech.

    Certainly, people had full opportunity to air their grievances at the rally held in conjunction with that sign this past Monday. People have also made full use of their first amendment rights to speak at public meetings and write into the health department.

    Public health measures such as requiring vaccinations and the wearing of masks have been ruled as constitutional in our country. The government has an interest in keeping the spread of diseases under control and, historically, some dangerous diseases have been eradicated by strong vaccination programs. Public health measures keep our medical systems from being overwhelmed and keep our economy strong by ensuring people can safely go about their daily lives.

    I continue to stand in full support of our public health director and his team for doing their jobs and working to promote public health and safety.

    Denver’s mask order is interesting in that you either wear a mask indoors or show your vaccine card.
    I watched businesses interviewed on the news last night and I was surprised at the lack of complaints. Although it’s just starting some have been doing it this way.
    I’d encourage you to contact Denver and ask how this is working for them.
    One of my big objections to masks is that I’m fully vaccinated and boostered and I’m being restricted just like the unvaccinated who are causing most of the hospital surge.
    I do realize vaccinated individuals can still trasmit the virus, but are far less likely to have as high viral loads and certainly less hospitalizations.
    This approach could encourage more people to get vaccinated.
