What is happening in Greeley is a warning to the rest of Colorado.
The city “bypassed” Colorado’s Taxpayer’s Bill of Rights (TABOR) by using an accounting trick known as Certificate’s of Participation (COPs).
And when citizens rallied behind a petition and initiative to put the project on the ballot, the city brought in “a hired-gun hearing officer” to make a legal argument that prevented the voters from having a say.
They city defied voters, the state constitution, and the principle of “consent of the governed,” in order to push through a massive city-owned entertainment complex.
Unfortunately, these schemes aren’t isolated to Greeley. Local governments have developed a playbook for forcing unpopular projects on their citizens.
